Tournament Organizer Agreement

1. Introduction

This Tournament Organizer Agreement ("Agreement") governs your use of the Spiker Pro platform to create, manage, and operate volleyball tournaments. By creating a tournament on Spiker Pro, you agree to be bound by this Agreement in addition to our general Terms of Service and Privacy Policy.

Spiker Pro provides digital tools to facilitate tournament management. Spiker Pro is a technology platform only and does not organize, supervise, or control any tournament or event.

2. Organizer Eligibility

  • You must be at least 18 years old to create a tournament on Spiker Pro.
  • You must have an active Spiker Pro account in good standing.
  • You represent that you have the legal authority and capacity to organize the tournament, including any required permits, licenses, or venue agreements.

3. Tournament Creation & Accuracy

  • Accurate Information: You are solely responsible for ensuring all tournament details are accurate and complete, including but not limited to: tournament name, dates, times, venue location, format, rules, division structure, entry fees, and eligibility requirements.
  • Timely Updates: You must promptly update tournament information if any details change, including schedule modifications, venue changes, or cancellations.
  • No Misrepresentation: You shall not create tournaments with fraudulent, misleading, or deceptive information. Doing so may result in immediate account suspension.

4. Fees & Payments

4.1 Platform Fees

  • A per-division creation fee may be charged when publishing a tournament. The fee amount is displayed before payment and is non-refundable once a tournament is published.
  • Spiker Pro may charge payment processing fees on player registration payments. Fee breakdowns are shown to players before payment.
  • Platform fee amounts are subject to change. You will be notified of any fee changes before they take effect.

4.2 Player Registration Fees

  • You set the entry fees for your tournament. You are responsible for ensuring fees are reasonable and clearly communicated.
  • Registration payments collected through Spiker Pro are processed via Stripe and deposited to your connected Stripe account minus applicable platform and processing fees.

4.3 Refunds & Cancellations

  • You must establish and clearly communicate a refund policy for your tournament.
  • If you cancel a tournament, you are responsible for issuing full refunds to all registered participants. Spiker Pro platform fees are non-refundable.
  • Player withdrawal refunds are processed according to your stated cancellation policy. A platform cancellation fee may be deducted as disclosed at registration time.

4.4 Tax Responsibility

You are solely responsible for all tax obligations arising from tournament fees and earnings received through the platform, including but not limited to income tax, sales tax, and self-employment tax. Spiker Pro does not provide tax advice and is not responsible for withholding or remitting taxes on your behalf.

5. Player Safety & Liability

  • Venue Safety: You are solely responsible for ensuring the tournament venue is safe and suitable for competitive volleyball, including court surfaces, nets, lighting, spectator areas, parking, and emergency access.
  • First Aid: You should have appropriate first aid equipment and personnel available at your tournament venue.
  • Emergency Procedures: You must have emergency procedures in place, including contact information for local emergency services.
  • Weather Decisions: You are solely responsible for making weather-related decisions, including postponement or cancellation due to unsafe conditions (heat, lightning, storms, etc.).
  • Participant Conduct: You are responsible for managing participant conduct and enforcing tournament rules, including ejection of participants who violate rules or engage in unsportsmanlike behavior.
  • Spiker Pro Not Liable: Spiker Pro is not responsible for any injuries, accidents, property damage, or other losses occurring at your tournament. You agree to indemnify and hold Spiker Pro harmless from any claims arising from your tournament.

6. Insurance

We strongly recommend that you obtain and maintain appropriate event liability insurance for your tournaments. This may include:

  • General liability insurance covering bodily injury and property damage
  • Sports event insurance for athletic activities
  • Any insurance required by your venue or local regulations

Spiker Pro does not provide, arrange, or verify insurance coverage for organizers or their events.

7. Waivers

  • You are responsible for collecting and enforcing any required liability waivers from tournament participants.
  • Spiker Pro provides digital waiver tools as a convenience. The legal enforceability and adequacy of waivers is your responsibility. We recommend consulting with a legal professional.
  • You must ensure all participants have signed required waivers before competing.

8. Legal Compliance

You must comply with all applicable local, state, and federal laws and regulations, including but not limited to:

  • Business licenses and event permits
  • Health and safety codes
  • Noise ordinances and local regulations
  • Anti-discrimination and accessibility laws (ADA)
  • Age verification requirements for minors
  • Food and beverage regulations (if applicable)

9. Data & Privacy

  • You will receive access to participant information (names, contact details) for the purpose of organizing and communicating about your tournament.
  • You must handle participant data in compliance with our Privacy Policy and applicable privacy laws.
  • You shall not use participant information for purposes unrelated to the tournament, including unsolicited marketing, selling data to third parties, or sharing data without consent.

10. Match Results & Integrity

  • You are responsible for accurately recording match results and scores.
  • Scores submitted through Spiker Pro affect player Elo rankings. Submitting fraudulent or inaccurate scores may result in account suspension and retroactive ranking corrections.
  • You must establish and communicate fair dispute resolution procedures for score or rule challenges during your tournament.

11. Co-Organizers

  • You may invite co-organizers to help manage your tournament. You are responsible for the actions of co-organizers you appoint.
  • Co-organizer access can be revoked at any time by the primary organizer.
  • Co-organizers must also agree to this Agreement.

12. Content & Branding

  • You retain ownership of tournament names, logos, and descriptions you create.
  • You grant Spiker Pro a non-exclusive license to display your tournament information on the platform, marketing materials, and public tournament pages.
  • You must not use Spiker Pro's name, logo, or branding in a way that implies endorsement or sponsorship without prior written consent.

13. Suspension & Termination

Spiker Pro may suspend or terminate your ability to organize tournaments if you:

  • Violate this Agreement or our Terms of Service
  • Create tournaments with fraudulent or misleading information
  • Receive multiple complaints from participants
  • Fail to process required refunds
  • Submit fraudulent match results or scores
  • Fail to maintain safe tournament conditions

In the event of suspension, pending payouts may be held until disputes are resolved.

14. Indemnification

You agree to indemnify, defend, and hold harmless Spiker Pro, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your tournament or any event you organize through the platform
  • Any injury, death, or property damage occurring at your tournament
  • Your violation of this Agreement, our Terms of Service, or applicable law
  • Any dispute between you and tournament participants
  • Your failure to obtain necessary permits, licenses, or insurance
  • Any tax obligations you fail to report or pay

This indemnification obligation survives termination of your account and this Agreement.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIKER PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM TO ORGANIZE TOURNAMENTS.

SPIKER PRO SHALL HAVE NO LIABILITY FOR ANY PHYSICAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM TOURNAMENTS OR EVENTS ORGANIZED THROUGH THE PLATFORM.

Our total liability for any claim related to this Agreement shall not exceed the total platform fees you have paid to Spiker Pro in the twelve (12) months preceding the claim.

16. Dispute Resolution

This Agreement is governed by the laws of the State of California, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of California.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

17. Changes to This Agreement

We may update this Agreement at any time. If we make material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Continued creation or management of tournaments after changes constitutes acceptance.
